Terms of Use

1. Acceptance of terms

By creating an account or using Prop IQ ("Prop IQ", "we", "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use Prop IQ.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in Australia.

3. Nature of our service

Prop IQ provides information and technology services for Australian homeowners, buyers and real estate agents. We are not a licensed valuer, real estate agent, solicitor, financial adviser, tax adviser or lender. Nothing on Prop IQ constitutes legal, financial or taxation advice.

4. Account creation

You are responsible for:

• providing accurate account information;
• keeping your password confidential;
• all activity that occurs under your account.

Notify us immediately if you suspect unauthorised access.

5. Acceptable use

You agree to use Prop IQ only for lawful purposes and to:

• respect the intellectual property rights of Prop IQ and third parties;
• comply with all applicable laws, including anti-discrimination, privacy and consumer protection laws;
• only upload information you have a right to upload.

6. Prohibited activities

You must not:

• scrape, crawl or systematically extract data from Prop IQ;
• attempt to reverse engineer or bypass our security controls;
• upload unlawful, misleading, defamatory or infringing content;
• use Prop IQ to harass, spam or defraud any person;
• impersonate any person or entity;
• resell or sublicense Prop IQ services without our written consent.

7. Intellectual property

Prop IQ, its brand, software, design and content are owned by us or our licensors. You are granted a limited, revocable, non-exclusive licence to use Prop IQ for its intended purpose. All other rights are reserved.

8. User-generated content

You retain ownership of the property information, photos and documents you upload. By uploading, you grant Prop IQ a worldwide, royalty-free licence to store, display and process that content for the purpose of providing the service to you (including AI analysis).

9. AI-generated content

Prop IQ uses AI to produce summaries, insights and recommendations. AI output can be incorrect or incomplete. See our AI Disclaimer for details. You are responsible for how you use AI-generated content.

10. Property estimates

Property values, ranges, rent estimates and improvement recommendations are automated estimates, not certified valuations. See our Property Estimate Disclaimer.

11. Third-party property data

Where we display data supplied by third parties (for example, PropTrack, Cotality or Domain), that data is subject to the third party's own terms and disclaimers. We do not warrant its accuracy or completeness.

12. Subscription services

Paid features are governed by our Subscription Terms and Refund & Cancellation Policy.

13. Service availability

We aim to keep Prop IQ available at all times but we do not guarantee uninterrupted service. We may perform maintenance, updates and changes without notice.

14. Suspension and termination

We may suspend or terminate your account (with or without notice) if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or exposed Prop IQ or other users to risk.

You may close your account at any time from your account settings.

15. Limitation of liability

To the maximum extent permitted by law:

• Prop IQ is provided "as is" and "as available";
• we exclude all implied warranties, other than those that cannot be excluded under the Australian Consumer Law;
• our total liability to you in connection with Prop IQ is limited to the amount you have paid us in the 12 months preceding the event giving rise to the claim, or, at our option, re-supplying the service.

Nothing in these Terms limits your rights under the Australian Consumer Law.

16. Indemnity

You agree to indemnify Prop IQ against any loss, cost or claim arising from your breach of these Terms or your misuse of the service.

17. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.

18. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.

19. Changes to these Terms

We may update these Terms from time to time. Material changes will require your acceptance before you can continue using affected services.
